Terms of Service

Welcome to Pentagon. These Terms of Service ("Terms") govern your access to and use of Pentagon (the "Software" or "Service"), provided by Dark Research, LLC ("Dark Research," "we," "us," or "our"). By downloading, installing, or using Pentagon, you agree to be bound by these Terms.

1. License Grant

Subject to your compliance with these Terms, Dark Research grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use Pentagon for your personal or internal business purposes. This license does not include the right to:

  • Modify, adapt, or create derivative works of the Software
  • Reverse engineer, decompile, or disassemble the Software
  • Rent, lease, lend, sell, redistribute, or sublicense the Software
  • Copy, distribute, or publicly display the Software except as permitted by these Terms
  • Remove, alter, or obscure any proprietary notices in the Software

2. Intellectual Property Rights

Pentagon, including all content, features, and functionality (including but not limited to all information, software, code, text, displays, images, video, and audio, and the design, selection, and arrangement thereof), is owned by Dark Research, its licensors, or other providers and is protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

The Pentagon name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Dark Research or its affiliates or licensors. You may not use such marks without the prior written permission of Dark Research.

3. Your Content and Data

3.1 Local Storage

Pentagon is designed to store your code, conversations, and project data locally on your device. Your code never leaves your machine unless you explicitly choose to sync certain metadata through our optional cloud sync feature.

3.2 Cloud Sync (Optional)

If you choose to enable cloud sync via GitHub authentication, only instance metadata and configuration data (such as instance names, city statistics, and workspace settings) will be synced. Your source code, conversation content, and Claude API communications are never transmitted to our servers.

3.3 License to Metadata

By enabling cloud sync, you grant Dark Research a non-exclusive, worldwide, royalty-free license to use, store, and process your synced metadata solely for the purpose of providing the cloud sync service.

4. Third-Party Services

Pentagon integrates with and relies on third-party services, including:

We are not responsible for the availability, security, or functionality of these third-party services. Your use of third-party services is at your own risk and subject to their respective terms and policies.

5. Acceptable Use

You agree not to use Pentagon to:

  • Violate any applicable law, regulation, or third-party rights
  • Develop, generate, or deploy malware, viruses, or other harmful code
  • Attempt to gain unauthorized access to any systems or networks
  • Interfere with or disrupt the integrity or performance of the Software
  • Circumvent any security measures or access controls
  • Use automated scripts or bots to abuse the Software or related services
  • Impersonate any person or entity or misrepresent your affiliation

6. Updates and Changes

Dark Research may release updates to Pentagon from time to time. These updates may include bug fixes, new features, or changes to existing functionality. While we will endeavor to maintain backward compatibility, we reserve the right to modify or discontinue features at our discretion. Continued use of Pentagon after updates constitutes acceptance of any modified terms.

7. Disclaimer of Warranties

PENTAGON IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, DARK RESEARCH DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

  • MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE
  • NON-INFRINGEMENT
  • ACCURACY, COMPLETENESS, OR RELIABILITY OF CONTENT
  • UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE OPERATION

YOU ACKNOWLEDGE THAT PENTAGON IS A TOOL THAT INTERFACES WITH AI SYSTEMS, WHICH MAY PRODUCE UNEXPECTED, INACCURATE, OR INAPPROPRIATE OUTPUT. YOU ARE SOLELY RESPONSIBLE FOR REVIEWING AND VALIDATING ANY CODE OR CONTENT GENERATED THROUGH YOUR USE OF PENTAGON.

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL DARK RESEARCH, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES
  • DAMAGES RESULTING FROM UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR DATA
  • COST OF PROCUREMENT OF SUBSTITUTE GOODS OR SERVICES
  • ANY MATTER BEYOND OUR REASONABLE CONTROL

OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SOFTWARE SHALL NOT EXCEED THE GREATER OF: (A) ONE HUNDRED DOLLARS ($100) OR (B) THE AMOUNTS PAID BY YOU TO DARK RESEARCH IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

9. Indemnification

You agree to indemnify, defend, and hold harmless Dark Research and its affiliates, officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or in connection with:

  • Your use of Pentagon
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Any content or code you create, store, or process using Pentagon

10. Governing Law and Dispute Resolution

10.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.

10.2 Binding Arbitration

Any dispute arising out of or relating to these Terms or the Software shall be resolved by binding arbitration administered by the American Arbitration Association in accordance with its Commercial Arbitration Rules. The arbitration shall be conducted in San Francisco, California. The arbitrator's decision shall be final and binding.

10.3 Class Action Waiver

YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. You waive any right to participate in class actions or class-wide arbitration.

11. Termination

We may terminate or suspend your access to Pentagon immediately, without prior notice or liability, for any reason, including without limitation if you breach these Terms. Upon termination, your right to use Pentagon will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

12. General Provisions

12.1 Entire Agreement

These Terms constitute the entire agreement between you and Dark Research regarding Pentagon and supersede all prior agreements and understandings.

12.2 Severability

If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced.

12.3 Waiver

The failure of Dark Research to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

12.4 Assignment

You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms without restriction.
